This policy (together with our end-user licence agreement as set out through the link in our log in page (“EULA”)) and any additional terms of use incorporated by reference into the EULA, together “Our Terms of Use” applies to your access and use of the Whizz WiFi wireless service (“Service”).

 

This policy sets out the basis on which any personal data We collect from you, or that you provide to us, will be processed by us. We ensure our firm commitment to your privacy vis-à-vis the protection of your priceless information. In order to endow you with our uninterrupted use of services, we may collect and, in some circumstances, disclose information about you. To enhance better protection of your privacy we provide this notice explaining our information practices and the choices you can make about the way your information is collected and used. Please read the following carefully to understand our views and practices regarding your personal data and how We will treat it.

 

1.      INFORMATION WE MAY COLLECT FROM YOU

 

We will collect and process the following data about you:

 

1.1.   Submitted Information: The log in information which you provide such as name, telephone number, address, valid e-mail address and/or information from your social media account through which you access the Service (e.g. Twitter, Facebook etc). This information will be taken from your social media access page and will be subject to your privacy settings. We may also ask you for information when you enter a competition or promotion and when you report a problem with any of our Service.

1.2.   Additional information: If you contact us, We may keep a record of that correspondence; We may also ask you to complete surveys that We use for research purposes, although you do not have to respond to them; details of transactions you carry out through our Service; details of your use of our Service including, but not limited to, location data, weblogs and other communication data and the resources that you access.

1.3.   Device information: We may collect information about the mobile telephone, smart phone, hand held device, laptop, computer or any other device used to access and use the Services (Device), including, where available, the Device's unique Device identifiers, operating system, browser type and mobile network information as well as the Device's telephone number if applicable, for system administration and to report aggregate information to our advertisers. We may associate Device information with Submitted Information and will treat the combined information as personal data in accordance with this policy for as long as it is combined.

4.4.   We may also use your data, or permit selected third parties to use your data, to provide you with information about goods and services that may be of interest to you.

4.5.   We will only contact you by electronic means (e-mail or SMS) with information about goods and services.

4.6.   Where We permit selected third parties to use your data, We (or they) will only contact you by electronic means.

4.7.   If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes then you should not use our Service. We provide access to the Service always in accordance with our Terms of Use and this Privacy Policy therefore if you do not accept them then we will cease to provide the Services to you until and unless you do accept them.

4.8.   We do not disclose information about identifiable individuals to our advertisers, but We may provide them with aggregate information about our users (for example, We may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We may make use of the personal data We have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience.

4.9.   We use your IP address to help diagnose problems with our server. Your IP address is also used by us to help identify you and to gather broad demographic information. Finally, we may use your IP address to help protect our partners and ourselves from fraud.

5.1.   We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in the Companies Act, 1956.

5.7.   If Whizz WiFi or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

5.8.   We may release your personal information to a third-party in order comply with a Court Order or other similar legal procedure, or when we believe in good faith that such disclosure is necessary to comply with the law; prevent imminent physical harm or financial loss; or investigate or take action regarding illegal activities, suspected fraud, or violations of our EULA. We may disclose personally identifiable information to parties in compliance with our Copyright Policy as mentioned in the Terms of Use as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, We may disclose name, address, country, phone number, email address and company name.

 

6.      THIRD PARTY SITES

6.1.   Our Services may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates (including, but not limited to, websites on which the Services are advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that We do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data.

You acknowledge and agree that We are not liable for any loss or damage which may be incurred by you as a result of the availability of those third-party sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such websites or resources. These third-party service providers and Third-Party Sites may have their own privacy policies governing the storage and retention of your personal information that you may be subject to. We recommend that when you enter a Third-Party Site, you review the Third Party Site’s privacy policy as it relates to safeguarding your personal information.

 

7.      Changes to privacy policy

7.1.   Any changes We may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by SMS or e-mail or notifying you of a change when log onto one of the Services Sites. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the Services.

7.2.   Should it be that you do not accept any of the modifications or amendments to the Terms, you may terminate your use of this website immediately.

10.  Security

10.1.                    In order to comply with Government of India regulations, we will authenticate your identity by use of an SMS sent to your nominated mobile number, which will contain a one-time password to activate the service. We will store your nominated mobile number in our database for a minimum period of one year. For security reasons, you may be required to re-authenticate yourself from time to time, for example after a period of inactivity on the connection between your browser and the WhizzWifi Service servers. WhizzWifi shall not be responsible for any information that you may lose if your session is terminated due to prolonged periods of inactivity between your browser and the WhizWifi Service servers.

10.2.                    You must not send or disclose your password to any other person or store it in a manner that would reasonably allow another person or entity to obtain access to it. You must not keep your password at a location where it is capable of being copied or used by any other person. WhizzWifi shall not be responsible if your password is copied and used for accessing WhizzWifi services. You must immediately notify WhizzWifi if you become aware that your user account details and password is known by a third party or of any unauthorized use of your password. In the event of such notification and verification, if any, WhizzWifi will take reasonable measures to change the password for you.

 

11.  Disclaimer

11.1.                    We cannot ensure that all of your private communications and other personal information (including sensitive information like credit card information and bank account number) will never be disclosed in ways not otherwise described in this Privacy Policy. Therefore, although we are committed to protecting your privacy, we do not promise, and you should not expect, that your personal information will always remain private. As a user of the Service, you understand and agree that you assume all responsibility and risk for your use of the Service, the internet generally, and the documents you post or access and for your conduct on and off the Service.
